“A navigable water is any body of water capable of being navigated by ... vessels of any description... . This would include both inland and coastal waters.”

Determination of navigability rests with the authority (Canadian Coast Guard).

“...Some Types of “Works” Requiring Approval” bridges, dams, wharves, piers, breakwaters, fill, submarine or overhead cables.*

  • Proposals to construct or alter Overhead or Submarine Cables crossing navigable waters normally require applications under the Navigable Waters Protection Act, Crown Lands and Beaches Acts.
     
  • Drawings for the proposed crossing will be compiled from L.I.S. mapping, Navigation Charts, Aerial Photos & field data for a preliminary application submitted on behalf of the customer.
     
  • Advertisement pursuant to the NWPA may be required for some work and the same will be arranged by LANDtech.
     
  • LANDtech will provide or coordinate the required surveys, which will be conducted and plans prepared in compliance with N. S. L. S. and Crown Land survey regulations on an “as built” bases.
     
  • Plans are provided to both authorities for charting and easement purposes.
